Mecavie Laser (“we”, “us”, or “our”) operates the website mecavielaser.com (the “Website”). By accessing, browsing or placing orders through the Website, you acknowledge and agree to be bound by the following Terms of Service (the “Terms”). Please read these Terms carefully.
1. Eligibility & Account
Business-First Customers: The Website is primarily intended for clinics, aesthetic medspas, distributors, OEM partners and other commercial buyers. By submitting an order via the Website, you warrant that you are duly authorized to make purchases on behalf of your organization.
Account Security: If you create an account on the Website, you are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account, including all orders placed. You agree to notify us immediately upon becoming aware of any unauthorized use of your account.
2. Product Information, Pricing & Orders
Product Descriptions: We strive to display accurate equipment specifications, parameters and descriptions; however, we do not warrant that product descriptions, images or other Website content are entirely error-free. Product images are for reference only. Actual items may vary slightly depending on production batches and models. All clinical treatment results and customer testimonials displayed are illustrative only. We make no guarantee of any aesthetic treatment outcome.
Pricing & Taxes: All prices are subject to change without prior notice. Prices exclude applicable sales tax, customs duties and shipping fees unless explicitly stated otherwise on the product page.
Order Confirmation: After you submit an order, you will receive an automated order confirmation email. This confirmation does not constitute acceptance of your order. We reserve the right to refuse, cancel or restrict any order for any reasonable cause, including without limitation insufficient inventory, pricing errors, payment verification failure, import/export regulatory restrictions or suspected fraudulent transactions.
Acceptance of Order: A binding contract between you and us is formed only when we dispatch your goods and send you a formal shipping confirmation email. This shipping confirmation constitutes our official acceptance of your order.
3. Payment & Settlement
Accepted Payment Methods: We accept online payments via integrated payment gateways including Stripe, PayPal and WooPayments, supporting major credit cards such as Visa, MasterCard and American Express. Qualified commercial customers may apply for alternative payment terms such as bank transfer or net terms upon separate arrangement with our sales team.
Payment Authorization: By submitting an order, you authorize us to charge the full order amount via your selected payment method. All payment details are processed securely by third-party payment processors. We do not permanently store your full credit card information.
Deposits & Prepayments: Where an order requires a deposit, such deposit shall be non-refundable if you unilaterally cancel the order without valid cause. If we are unable to fulfill the order for legitimate reasons, we will refund all deposits received.
Billing, Customs & Duties: You agree to settle all applicable taxes, shipping and customs-related charges. You are solely responsible for obtaining all required import permits, aesthetic device certifications and customs clearance documentation in your destination country. You must provide accurate billing and contact information.
4. Shipping, Risk Transfer, Inspection, Returns & Refunds
Shipping and Transfer of Risk
We will ship goods to the delivery address you provide at checkout. Shipping timelines and carrier options are specified on the checkout page or within your order confirmation. All shipments are subject to the carrier’s terms of carriage.
Risk of loss, damage and title to the goods transfer to you immediately upon handover of the goods to the carrier. Any claims for loss or damage incurred during transit must be filed directly by you with the carrier.
Goods Inspection Obligation
Upon receipt of goods, you must complete unpacking inspection within 14 calendar days. Any claims for visible damage or missing parts must be submitted to us in writing with supporting photos and videos within this period. Failure to raise valid objections within the inspection window shall constitute acceptance that the goods have been delivered in satisfactory condition.
Returns & Refund Policy
We accept eligible returns within 30 days after delivery. The following categories are not eligible for non-customer-initiated returns:
- Large laser equipment (including diode lasers, picosecond lasers, multi-functional aesthetic platforms): These are professional commercial aesthetic devices requiring customized configuration and clinical adaptation. No non-refundable returns will be accepted for voluntary customer order cancellation. Manufacturing defects covered under warranty will be resolved via repair or component replacement, not full machine returns.
- Custom / OEM products (custom colors, logos, software configurations, bespoke packaging): Manufactured to your specific requirements and cannot be resold; returns are not permitted.
- Opened consumables, handpieces and invasive accessories: Hygiene restrictions apply. No returns once opened.
Unopened small spare parts (filters, cooling components etc.) may be returned within 30 days of delivery, provided original packaging remains intact. You must obtain a valid Return Merchandise Authorization (RMA) number from us before shipping any returns. Shipments received without a valid RMA will be rejected.
Where returns are requested due to customer preference, return shipping costs and restocking fees shall be borne by you. Where returns arise from our error such as incorrect items shipped, we will arrange replacement or process a refund. All refunds will be issued to the original payment method within 14 working days after we receive and inspect returned goods.
5. Force Majeure
Neither party shall be liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to war, geopolitical conflicts, port closures, shipping route disruptions, government import/export bans, customs policy changes, natural disasters, factory shutdowns and widespread logistics suspension. In such circumstances, we reserve the right to extend delivery timelines or terminate the relevant order and negotiate corresponding payment arrangements. We will notify you promptly once a force majeure event is confirmed.
6. Intellectual Property
All content displayed on the Website, including text, imagery, logos, product descriptions, technical specifications and software, remains the property of Mecavie Laser or its content licensors and is protected under international copyright and trademark laws. No reproduction, distribution or modification for commercial purposes is permitted without our explicit written consent.
You are prohibited from using crawlers, automated scraping tools to extract pricing, images and technical data from the Website. We reserve the right to suspend your account and pursue compensation for unauthorized data harvesting.
7. Prohibited Uses
You agree not to use the Website for any unlawful purpose, and shall refrain from any activity that may disrupt, damage or impair the Website’s servers and normal operation.
8. Limitation of Liability & Disclaimer
The Website, all products and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
To the fullest extent permitted by applicable law, Mecavie Laser shall not be liable for any indirect, incidental, special or consequential damages arising out of your use of the Website or purchased equipment. Our aggregate total liability under any claim shall not exceed the total amount paid by you to us within twelve (12) months prior to the claim arising.
We accept no liability for personal injury, third-party claims or adverse treatment outcomes caused by unauthorized equipment modification, improper operation or operation by untrained personnel.
9. Indemnification
You agree to indemnify, defend and hold harmless Mecavie Laser, its officers, directors, employees and agents from and against all claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising from your breach of these Terms, improper use of the Website or improper operation of equipment purchased from us.
10. Governing Law & Dispute Resolution
